Central Jakarta Court Has No Authority to Order Delay in Election, Says House Member

TEMPO.CO, Jakarta - Member of the House of Representatives (DPR) from the Prosperous Justice Party (PKS) Mardani Ali Sera responded to the Central Jakarta District Court’s ruling that ordered the General Elections Commission or KPU to postpone the stages of the 2024 general elections. The court has today ruled in favor of Prima Party which filed a lawsuit against the result of political party verification.
Mardani assessed that the court’s ruling could not hamper KPU from carrying out its duties and continuing the election process which will peak on February 14, 2024, given that it was a lawsuit of law violation or PMH which stated that the party led by Agus Jabo Priyono received civil harm. However, Mardani said other parties did not feel that way.
In addition, the KPU’s decision letter should have been studied and judged by the State Administrative Court. “Instead of the district court,” said Mardani to Tempo on Thursday, March 2.
As for the decision regarding the election date, Mardani said it is the authority of the Constitutional Court. On the other hand, he argued that the election stages have already begun and could not be interrupted because of one party issue. “So, this [court’s] decision does not prevent the KPU from continuing with the election stages.”
Earlier today, the Central Jakarta District Court ordered the KPU to postpone the stages of the 2024 elections and start the stages over from the beginning.
In response, the KPU is set to challenge the court’s ruling. “KPU will file an appeal against the District Court's decision. The KPU firmly rejects the decision and is submitting an appeal,” said KPU commissioner Idham Holik to Tempo on Thursday, March 2.
