TEMPO.CO, Jakarta - Families of the 24 victims of the Lion Air JT 610 crash filed a demand letter to Lion Air and its partner companies to pay for compensatio. The demand letter was delivered through the US-based legal firm Herrmann Law Group and local law firm Danto and Tomi & Friends.
"On behalf of victims, we demand Lion Air immediately pat each family IDR 1.254 billion as mandated by Indonesian law without signing illegal Release and Discharge," said the families' lawyer Charles Herrmann at Fairmont Hotel, Jakarta on Thursday, April 4, 2019.
In addition to Lion Air, the legal notice was delivered to an insurance company Tugu Pratama Insurance Co, Global Aerospace, and legal firm Kennedys Legal Solution.
The amount of the compensation was based on the Ministerial Decree No.77/2011 on the Responsibilities of Air Carriers at IDR 1.25 billion per victim and compensation of lost and damaged baggage at IDR 200.000 per kilogram or IDR 4 million per passenger at maximum.
Herrman continued to say that the insurance is similar to life insurance, and so victim's family will get compensation without proof of error or damage. However, Lion Air asked victim's family to sign the release and discharge to withdraw the insurance, by which they will lose the right to obtain full compensation from Lion Air, Boeing, and a thousand related corporates.
By the time this article is written, Lion Air Corporate Communications Strategic Danang Mandala Prihantoro and Tugu Pratama Corporate Secretary have yet responded to Tempo's request for confirmation.
