Ombudsman: TWK Must Not Be Used as Basis for Dismissing KPK Employees

TEMPO.CO, Jakarta - The Indonesian Ombudsman (ORI) asked the Corruption Eradication Commission (KPK) to convert the status of its employees who did not pass the national insight test (TWK) into state apparatus or ASN before October 30, 2021. This is considered as a corrective action for the KPK and the National Civil Service Agency (BKN).

The Ombudsman issued four points for KPK. “First, provide an explanation to KPK employees regarding the consequences of the TWK implementation and its results in the form of legal documents,” said the ORI member Robert Na Endi Jaweng in an online press conference on Wednesday, July 21.

The second point is that the test results should be used as input for corrective measures and should not be used as a basis for dismissing 75 employees who were deemed ineligible.

Besides, employees who failed to pass the test must be given the opportunity to make improvements by undergoing training on national insight.

“The transition of the status of KPK employees to ASN is in accordance with Law Number 19 of 2019 and Government Regulation Number 41 of 2020. And there is a maladministration in the process of drafting the KPK Regulation (PKPK) Number 1 of 2021,” Robert explained.

In addition, the Ombudsman demanded the BKN review the rules and prepare a roadmap in the form of mechanisms, instruments, and assessor preparation for the employees’ status change.

Robert hoped that this corrective action could be carried out by the KPK and BKN within 30 days after the report was sent. “If it is not implemented within 30 days, then the KPK and BKN will be given a recommendation and it must be implemented in the next 60 days,” said Robert.
