Wiretapping Draft Bill: Recording Destroyed After 2 Years

TEMPO.CO, Jakarta - The wiretapping draft bill (RUU) currently being formulated by legislators at the House of Representatives (DPR) prohibits wiretap recordings to be kept for more than two years after the initial wiretap was conducted.

Head of DPR’s legislation board Supratman Andi Agtas said that the regulation equally applies to law enforcers that engage in wiretapping, which include the Corruption Eradication Commission (KPK).

“Once [the recording] serves no more purpose, such as when a case is closed, the recordings must be destroyed,” said Supratman at the Senayan parliamentary complex on Thursday, July 4.

He explained that law enforcers could still use court trial facts if a case needs to be developed.

Moreover, KPK deputy chairman Muhammad Syarif said that he will discuss the regulation together with KPK’s enforcement deputy and study the draft bill on whether the expiration date needs to be extended.

The wiretapping file expiration date bill is one of the national legislation program (prolegnas) for 2019.
