Supreme Court Lifts Online Taxi Policy, Ministry Drafts New One

TEMPO.CO, Jakarta - The Director-General of Land Transportation Budi Setiyadi, said that the Ministry of Transportation was currently drafting a new regulation on online taxi services to amend the Transportation Ministry Decree No. 108 of 2017 (Permenhub 108/2017). Budi explained that the draft still requires further discussion.
"[The policy] is still a draft. I have held an internal meeting today, and this afternoon we will discuss it with the Organda [Land Transport Organization]," said Budi at the Coordinating Ministry for Economic Affairs office on Thursday, September 13, 2018.
As reported earlier, the Supreme Court (MA) ruled in favor of a substantive review request submitted on May 31, 2018, and published the ruling through MA's official website on September 12, 2018.
Some of the highlighted articles in Permenhub 108/2017 were considered to be in contradiction to Article 4 (2) of Law No. 8 of 1999 on Consumer Protection and Article 4 and 5 of Law No. 20 of 2008 on Micro, Small, and Medium Enterprises (MSME).
Budi further explained that several articles stipulated in Permenhub 108/2017 that were accepted by online taxi drivers would not be dropped, "and so we will not include those problematic articles to the revised one."
Budi mentioned one of the articles declined by the online taxi drivers was related to sticker installation on the vehicles. "But they accepted the inclusion of a vehicle quota. I forgot how many articles they agreed to." Budi concluded.
