DPR, KPU Assure Regional Election Law Abide Constitutional Court Rulings

TEMPO.CO, Jakarta - Deputy House Speaker, Sufmi Dasco Ahmad, said the House of Representatives (DPR) and the government have agreed to accommodate the Constitutional Court (MK) decision in the General Elections Commission (KPU) Regulation in the 2024 regional election.
Dasco said DPR has coordinated with the Minister of Home Affairs to comply with MK’s ruling. "So, the consultation on Monday [August 26] will not change anything,” said Dasco at the DPR Building, on Friday, August 23, 2024.
The Gerindra Party politician urged the public to avoid speculating about possible maneuvers that the government could do. Dasco ensured DPR and the government have agreed to heed public expectations.
"I emphasize that DPR and the government will both comply with MK’s ruling, which will be adopted into KPU Regulation,” Dasco said.
The Minister of Law and Human Rights, Supratman Andi Agtas previously said the government would follow DPR's decision to cancel the ratification of the Regional Head Election Bill on Thursday. Supratman said DPR had firmly stated its decision so there’s no need for further queries.
KPU to comply with MK’s ruling
KPU shared a similar stance with DPR and the government. KPU Head Mochammad Afifuddin said the commission will accommodate the Constitutional Court’s decision No. 70/PUU-XXII/2024 on the regional head candidate’s age requirements into the KPU Regulation.
"The age requirements for regional head candidates will be enforced since the candidate’s registration period,” Afifuddin said at the KPU office, in Jakarta on Friday, August 23, 2024.
According to Afifuddin, KPU will not revise Article 15 of the KPU Regulation No. 8 of 2024 concerning the minimum age requirement for regional head candidates. KPU will try to enforce the revision and technical guidelines of KPU Regulation to adopt the Constitutional Court’s decision before the registration of election candidates.
Previously, the Constitutional Court decided to annul a Supreme Court decision on regional election candidate age requirements. The June 4 decision of the Supreme Court stated that the candidate age limit must be enforced during the elected candidate’s inauguration. Meanwhile, MK ruled that the age requirement must be enforced during candidate registration.
