MK's Ruling for Regional Head Election's Age Requirement Not Guaranteed: DPR

TEMPO.CO, Jakarta - Deputy House Speaker Sufmi Dasco Ahmad of the House of Representatives (DPR) could not guarantee the regulation for age requirements of regional candidates in the upcoming regional head election. According to Dasco, the age requirements will be ruled under the General Elections Commission Regulation (PKPU).
Dasco said the DPR and the General Elections Commission (KPU) will discuss the regulation together. “PKPU will be consulted with DPR and drafted by KPU,” he said on Thursday evening, August 22, 2024.
According to Dasco, the KPU regulation will be discussed on Monday, August 26. “People can follow the consultation meeting between KPU and the Commission III of DPR on Monday to get the answers (of age requirement),” he said.
Dasco said there are currently two conflicting court decisions as references for minimum age requirements for regional head candidates in the upcoming regional head election. The rulings are Supreme Court (MA) decision No. 23 P/HUM/2024 and Constitutional Court (MK) decision No. 70/PUU-XXII/2024.
MK’s ruling enforces a 30-year-old age requirement for governor candidates and a 25-year-old for regent or mayor candidates during the regional head candidacy’s registration period. Meanwhile, the MA’s decision enforces the age requirement during the regional head-elect’s inauguration.
The MK’s ruling does not automatically annul MA’s decision, Dasco said. “We’ll review the Supreme Court and Constitutional Court decisions since I believe even MK agrees that its decision cannot annul Supreme Court’s judicial review,” he said.
Dasco said KPU has not decided which court rulings will be implemented in PKPU. “Thus, we will ask KPU to draft the PKPU after a consultation with DPR,” he added.
Previously, DPR attempted to implement the Supreme Court’s decision as a reference for the candidate’s age requirements in the upcoming regional head election. This sparked mass protests across several regions in Indonesia.
