Jakarta High Court Upholds Ferdy Sambo's Death Sentence

TEMPO.CO, Jakarta - The Panel of Judges at the Jakarta High Court rejected the appeal filed by Ferdy Sambo in today's trial, April 12, and upheld the death sentence of the former head of the Police's Professional and Security Division (Propam).
In the appeal, Sambo's lawyer questioned the death penalty handed down by the South Jakarta District Court. They stated that such a punishment violates human rights.
The panel of judges led by Singgih Budi Prakoso considered that the death penalty remains necessary in Indonesia to present a deterrent effect on perpetrators of crimes.
“The death penalty is still needed as a shock therapy or deterrent effect. The psychological basis also affects law enforcement in Indonesia,” said Singgih when reading out the appeal verdict at the Jakarta High Court, Wednesday, April 12.
The death penalty is still regulated in Indonesian positive law
The judge stated that the death penalty is also still regulated in Indonesian positive law to this day, and is even included in the Criminal Code which was ratified some time ago. Although in the new rules, the death penalty is carried out selectively by considering the gravity of the crime.
According to Singgih, the Constitutional Court stated that the death penalty is not against the 1945 Constitution as it does not regulate absolute human rights.
The South Jakarta District Court led by Chief Judge Wahyu Iman Santoso sentenced Sambo to death for being guilty of masterminding the premeditated murder of his aide Brigadier Joshua. This sentence was heavier than the Prosecutor's demands of life imprisonment. Ferdy Sambo then filed an appeal on February 15, 2023.
