KPK Accuses Ombudsman of Violating Constitution over TWK Report

TEMPO.CO, Jakarta - The Corruption Eradication Commission (KPK) objected to taking corrective actions as requested by the Indonesian Ombudsman related to the implementation of the change of employees’ status to state civil apparatus. The Ombudsman was accused of violating the constitution for examining the report on the national insight test or TWK.
“Ombudsman examined a case with the main point of testing the validity of the regulation formation, which is the absolute competence of the Supreme Court,” said the anti-graft deputy chair Nurul Ghufron in his office, Thursday, August 5.
Ghufron said Article 24 of the Constitution states that the Supreme Court has the authority to examine the regulations, both formally and materially.
In addition, the establishment of the KPK Regulation on the change of employees’ status was being investigated in court. “There is an institution participating in the investigation, carrying out an examination, or even preceding the case. This must be seen as a violation against the constitution,” he remarked.
Ghufron opined that the Ombudsman should reject the appeal to examine the report so as not to interfere with the judge's freedom in making rulings. He added that the Ombudsman's internal rules also noted the ban on examining objects of the court’s investigation.
The KPK submitted 13 points of objection to the Ombudsman’s findings regarding the implementation of the transfer of employees’ status. The objection letter would be sent as early as tomorrow, August 6.
