TEMPO.CO, Jakarta - Criminal law expert Abdul Fickar Hadjar opined that celebrity Dinar Candy was arrested for showing pornography in public. According to him, staging a demonstration wearing only a bikini in public areas was classified as pornography.

“Yes, [it is pornography] unless [she did so] in bathroom or beach,” Abdul said via a text message on Thursday, August 5.

The Jakarta Metro Police arrested the female disk jockey on Wednesday night, August 4, after video footage of her staging a solo rally against the government’s public mobility restriction dubbed PPKM Level 4 by wearing a two-piece red bikini went viral on social media.

Abdul said people echoing their voices through demonstration could not be detained as it is a form of freedom of expression which is guaranteed by the constitution. “What is prohibited is the act of pornography.”

Dinar Candy, Abdul argued, violated Article 36 of Law No. 44 of 2008 concerning Pornography. The article stipulates that anyone who shows himself in public depicting pornography is threatened with a maximum of 10 years imprisonment or a maximum fine of Rp5 billion.
