Minister Says Draft of Job Creation Derivative Rules 90% Completed

TEMPO.CO, Jakarta - The Ministry of Agrarian Affairs and Spatial Planning/National Land Agency (ATR/BPN) is preparing five government regulations (PP) as derivative rules of the Omnibus Law on Job Creation. Minister Sofyan Djalil said the draft formulation is nearly completed.

“The RPP (draft of government regulation) has been deliberated here for three days by me and the ministry's director-general. It's 90 percent completed today,” said Sofyan in a virtual press conference on Friday, October 16, 2020.

The five derivative rules of the new omnibus law include the policy on the implementation of spatial planning, land banking, land rights provision, the implementation of land acquisition for the public interest, and on abandoned areas and lands.

According to Sofyan, the Job Creation Law and its derivatives will provide certainty in the process of land acquisition for public facilities, such as airports and toll roads. The new policy also amended several articles stipulated in Law No. 2/2012 on land procurement.

In addition, the derivative rules will manage land banking, which was expected to give people the opportunity to obtain affordable and even free plots of lands for public residences in urban areas. The land banking will switch the function of abandoned lands or lands under the rights-to-cultivate (HGU) permit that has expired and not extended.

Sofyan Djalil further guaranteed the land ownership rights for indigenous peoples and the government would not reduce the availability of land for agrarian reform.
