Attorney General's Office Anticipates General Elections Offenses, Maintain Neutrality

TEMPO.CO, Jakarta - Attorney General Sanitiar Burhanuddin stated that general elections-related criminal offenses still happened frequently, especially for those with less than five years in prison, and were not enforced with an arrest.
"This became a legal loophole for the perpetrators to avoid justice by stalling the process of handling general elections criminal offenses," Burhanuddin said during a working meeting with Commission III of the House of Representatives on Thursday, November 16.
According to Burhanuddin, the Attorney's General Office is supporting the upcoming general elections by presenting the coordination pattern with the Integrated Law Enforcement Center (Gakkumdu) to handle election-related crimes to maintain its neutrality.
"As we know, election offenses are handled by the integrated law enforcement center in coordination with the General Elections Supervisory Board (Bawaslu) and the National Police," he said. This was in line with Article 486 (1) of the General Elections Law.
Concerning the general elections, Burhanuddin also explained the security coordination pattern that will soon be implemented by the Attorney General's Office.
"We can explain briefly that the coordination pattern we employ is the mutual discussion to ensure our perception is uniformed in every stage," he said.
The pattern is regulated under the Bawaslu Regulation No. 3 of 2023 on Gakkumdu, which consists of eight stages. "These stages are studies, education, plenary sessions, elections supervision, pre-trial education, charges, and execution of court decisions," he said.
The AGO, he added, in anticipation of law enforcement as a tool of practical politics, adopted Attorney General Instruction No. 6 on the optimization of AGO's roles to support the general elections in 2024.
The office also must maintain its neutrality during the election, ensuring that it will not be used by any parties to advance their interests, Burhanuddin said.
