Govt Meets Google, Meta Amid Publisher's Rights Decree Formulation

TEMPO.CO, JakartaThe Indonesian government is currently formulating rules of cooperation between mass media and digital platforms which will later be issued under the Publisher Rights Presidential Decree (Perpres). 

The Communication and Information Ministry’s director general of information and communication Usman Kansong said a meeting with Google and Meta has agreed to discuss the initial design for the regulation.

“We invited a number of digital platforms in January, which we think is significant. But only two that present, Meta or Facebook and Google,” said Usman to Tempo in a phone interview on February 16.

In the meeting, the government submitted the publisher’s rights early draft and also received feedback from two tech giants, which contains the same material that was discussed together with the Press Council, constituents, and state ministries. 

According to Usman, the decree would regulate the media business ecosystem. He emphasized that cooperation between digital platforms and mass media would be carried out on a business-to-business (B2B) basis so that there would be a process of negotiation between parties regarding the results of advertising, compensation, or remuneration. 

This process will also be regulated further in the derivative rules made by implementing regulations.

The government will form an agency or institution that will oversee the cooperation process that will take the role of mediating media and digital platforms that do not reach an agreement.

"If the mediation turns out unsuccessful and there are parties who want to apply for arbitration, then that opportunity is opened. For example, to the Indonesian National Arbitration Board, KPPU (Business Competition Supervisory Commission), or civil law," he said.

The rules being drafted are claimed to take into account the principle of freedom or freedom of the press. Because, according to Usman, the government will only regulate the business side and will not regulate aspects of the press or journalism.

As previously reported, President Joko “Jokowi” Widodo said that the Presidential Decree on Publisher Rights is prepared to help mass media deal with foreign platforms. The President is sure that the Perpres would be completed soon with a meeting of the Kominfo and the Press Council.
