Expert Witness: Richard Eliezer Deserves Justice Collaborator Status

TEMPO.CO, Jakarta - The lawyers of Richard Eliezer a.k.a. Bharada E called in criminal expert Albert Aries as a de-charge expert witness for his client's defense in Wednesday's hearing of Brigadier J's murder trial, on December 28. In his testimony, Albert said that Richard deserves the status of a justice collaborator.
In this case, Richard is a justice collaborator from the Witness and Victim Protection Agency (LPSK).
Albert Aries is a member of the Discussion Team and Spokesperson for the Draft Criminal Code (RKUHP). The criminal expert from Trisakti University said that Article 5 Paragraph 2 of Law 31/2014 on Protection of Witnesses and Victims stipulates that the justice collaborator status can be given to witnesses and victims if an act of crime can put the witness or victim in a threatened position.
"It says that other criminal acts resulted in the position of the witness or victim being placed in a situation that was very life-threatening. This means that the status is assessed objectively by the LPSK in providing this protection," Albert said.
Albert also mentioned that the conditions for granting justice collaborator status are also regulated in Article 28 of the Law on Protection of Witnesses and Victims, in which it is stated that the status can be given to parties who are not the main actors in a crime.
However, Albert said there are several items in the article that do not need to be met cumulatively. One example is returning assets unrelated to the murder.
"When [the person] meets the requirements specified in article 28 and according to the explanation of article 5 paragraph 2, which is an objective measure, the protection can be given to someone who actually wants to reveal a crime," said Albert.
