FRI Claims Omnibus Law is Invalid as it Failed to Meet Schedule Set by DPR

TEMPO.CO, Jakarta - The civil society coalition dubbed “Indonesian People’s Faction” (Fraksi Rakyat Indonesia/FRI) argues that the omnibus job creation law had passed the deadline to be handed to President Joko “Jokowi” Widodo and maintains that this makes the law’s passing invalid. 

The coalition refers to the House of Representatives (DPR) Regulation No.2/2020 on the formation of a Law which states that draft laws must be handed to the president within seven days since it was passed. 

“As we all know, the House plenary that passed the omnibus job creation law was on October 5. This means that the draft must be handed in at the latest on October 13, 2020, which is one day ago,” the coalition wrote in Wednesday's press release. 

This also disputes the statement made by DPR deputy speaker Azis Syamsuddin, who said the draft of the job creation law will be inaugurated on October 14 after it was handed over to the president. Azis argues that the deadline is on October 14 at midnight and not on October 13. 

“This adds to many previous procedural defects which makes this draft law not able to meet the formal requirements needed to consider it an official Law,” they wrote.
