Cohabitation Is Crime in Final Draft of Criminal Code Bill

TEMPO.CO, Jakarta - Cohabitation or the acts of people living together as partners and engaging in sexual intercourse outside wedlock is considered a crime in the final draft of the Criminal Code bill.

Deputy Minister of Law and Human Rights Edward Omar Sharif Hiariej submitted the final draft bill or RKUHP to the House of Representatives (DPR) Commission III on Wednesday, July 6, 2022.

In the final draft received by Tempo, Article 416 contains the prohibition of cohabitation or locally known kumpul kebo. “Those who live together as husband and wife outside of marriage is sentenced to maximum imprisonment of 6 (six) months or a maximum fine of category II,” as read in Article 416 of the draft bill.

However, the crime can only be prosecuted based on a complaint, which can also be withdrawn so long the examination in court has not yet started.

In Indonesia, cohabitation has become a matter of controversy, from a religious point of view, state law, or customary law.

Lawyer-cum-politician Gayus Lambuun voiced criticism. He said the issue of decency has never been addressed by the state because the country has no right to regulate the matter. He cited that Article 28 of the 1945 Constitution guarantees the protection of the private rights of citizens.
