KPK Urged to Hold Corporations Liable for Corruption

TEMPO.CO, Jakarta - The Gadjah Mada University anticorruption studies center, or Pukat UGM, on Thursday, has urged the Corruption Eradication Commission (KPK) to hold corporations liable for the bribery case of Yogyakarta Mayor Haryadi Suyuti.

One of the studies center researchers Zaenur Rohman believes this way will create a deterrent effect for other corporations that try to conduct shady businesses.

“This is important to deter other corporations that plan to operate in Yogyakarta from using illegal practices such as graft or gratifications,” said Rohman at the Yogyakarta Legal Aid headquarters on June 9.

The anti-graft watchdog had actually named the VP of Summarecon Agung Oon Nusihono as a suspect of bribery. However, the researcher argues that it is not enough and believes that corporate management should be liable for criminal punishments.

The Yogyakarta Mayor was arrested last week with reports suggesting he was in the process of receiving US$27,000 from Nusihono to make way for the construction of a luxurious apartment by Summarecon Agung.

"In such a context, the corporation must also be held criminally responsible, so it must use a corporate criminal liability approach,” said Rohman.

According to Supreme Court Regulation (Perma) No. 13/2016, the researcher said that KPK can ensnare corporations that allow or do not take steps to prevent criminal acts from occurring.
