TEMPO.CO, Jakarta – Constitutional law expert Refly Harun said Tuesday that Prabowo Subianto-Hatta Rajasa's camp's lawsuit against the election results could theoretically annul or delay the victory of president-elect Joko Widodo.
However, he also said Prabowo’s appeal would be difficult to be granted by the Constitutional Court (MK). “The reason is simple: the report on suspected frauds on the number of votes has weak arguments,” said Refly.
Refly said the results of vote tally based on C1 forms carried out by Prabowo’s campaign team were not 100 percent. He added the team had also failed to prove the massive and structured electoral frauds they claimed to have been committed by rival Jokowi’s camp in their reports. “They’re only disputing the irregularities that are not necessarily frauds,” said Refly.
Among them, Refly said, were the disputed voters lists that the Prabowo team claimed to be suspicious. “They claim a large number of voters to be unusual, but who knows who was harmed because of them? It’s not a fraud if they only used their voting right once. Even if they voted more than once, where’s the proof?”
In addition, Refly said, the report filed by the Prabowo camp against the electoral results was incomplete. He explained there are several parts in the 55-page report that were left empty, signaling the report was written in haste and sans the necessary details and data.
