TEMPO.CO, Jakarta - Gerindra Party deputy chairman Ferry Juliantono said that the National Armed Forces (TNI) and the police have to be jointly involved in counterterrorism measures. At present, the TNI involvement is being deliberated extensively by the government and the House of Representatives (DPR).
Ferry Juliantono said that the philosophy of law enforcement in Anti-Terror Law ought to be supplemented by the philosophy of security disturbances of both terrorism and separatism. The change in philosophy would underpin the TNI and police joint efforts in the prevention and law enforcement against terrorism.
He said that the negative effects of the two institutions’ involvement in the implementation of the law as feared by the people should be minimized.
Ferry said that the Anti-Terror Law should cover the philosophy of defense from potential threats to state sovereignty. He said that the adoption of ‘clear and present danger’ doctrine would be justified.
“Emergency laws apply in emergency situations and emergency conditions that put state sovereignty above anything else in accordance with the universal doctrine and jurisprudence and in accordance with TAP MPR [decree of the People’s Consultative Assembly] Number VII/2000 and Article 30 of the 1945 Constitution,” Ferry said.
The government and the House’s Anti-Terrorism special committee are deliberating the revision to Law No. 15/2003 on Anti-Terrorism. The government sees that the TNI involvement would be needed in counterterrorism measures.
