TEMPO.CO, Jakarta - Indonesia Corruption Watch (ICW) revealed that at least 56 former corruption convicts are vying for legislative seats in the upcoming 2024 elections. Although it may seem strange, ex-corruptors who have served their sentences are actually eligible to register as legislative candidates.
This is made clear in the KPU Regulation or PKPU No. 31 of 2018 on amendments to PKPU No. 20 of 2018 on nominations for members of the House of Representatives (DPR), Provincial Legislative Council (DPRD), and Regency or City DPRD. This regulation has been in effect since the 2019 election.
However, former corrupt convicts are only allowed to run for election under certain conditions. They must attach a certificate from the head of the correctional institution or prison stating that they have completed serving their prison sentence based on a court decision, as well as a copy of the court decision which has permanent legal force.
Additionally, they must attach a letter from the editor-in-chief of a media outlet stating that they have openly and honestly declared to the public that they are an ex-convict. The publication in the mass media must also be presented as evidence to the KPU.
This regulation was strengthened by PKPU Number 18 of 2019, which was issued on December 6, 2019. The KPU only prohibits former convicts of drug cases and sexual crimes against children from becoming legislative candidates in the elections.
Former convicts of other cases are also allowed to run in the elections as long as they have not been sentenced to five years or more in prison.
