Constitutional Court Rejects Petition to Lower Presidential Age Limit to 35

TEMPO.CO, Jakarta - The Indonesian Constitutional Court (MK) rejected the petition to lower the minimum age requirement for presidential and vice presidential candidates to 35 years. Chief Justice Anwar Usman read the decision on Monday, October 16, 2023.

“[The court] decides to reject all the petitions,” Chief Justice Anwar Usman read the court’s ruling on Monday.

Anwar said two of the nine judges had dissenting opinions regarding the eligibility rules for the presidential and vice presidential candidates, namely Suhartoyo and Guntur Hamzah.

Petition No. 29/PUU-XXI/2023 was previously filed by petitioners, including the Indonesian Solidarity Party or PSI (Petitioner I), Anthony Winza Probowo (Petitioner II), Danik Eka Rahmaningtyas (Petitioner III), Dedek Prayudi (Petitioner IV), and Mikhail Gorbachev (Petitioner V).

This was a judicial review of Article 169 (q) of the General Elections Law No.7 of 2017 regarding the age limit for presidential and vice presidential candidates. The article set the minimum age limit for presidential and vice presidential candidates at 40 years.

The petitioners requested that the presidential age limit be lowered to 35 years.
