Richard Eliezer's Sentence Final and Binding as AGO Won't File Appeal

TEMPO.CO, JakartaThe Attorney General's Office stated that the verdict against Richard Eliezer Pudihang Lumiu in the premeditated murder has become final and binding or inkracht since no appeal would be filed.

“This decision reaches inkracht, so it has a permanent decision,” said Deputy Attorney General for General Crimes Fadil Zumhana at his office, in Jakarta, Thursday, February 16, 2023.

Fadil explained AGO's decision not to file an appeal was taken based on several considerations, especially the fact that the family of the victim, Brigadier Nofriansyah Yosua Hutabarat, has forgiven Richard.

According to him, the statement should be considered as the prosecutor is a representative of the victim, the state, and the community. Besides, it is a concept upheld in national law and customary law. 

The prosecutor also believed that the court had taken into account all the prosecutor’s considerations. Fadil argued that the sentence is the absolute authority of the judge. “The judge must have his own considerations,” he said.

South Jakarta District Court sentenced Richard Eliezer to 1 year and 6 months in prison in the premeditated murder case of Brigadier J. The sentence was much lighter than the prosecutor's demand of 12 years in prison.

The presiding judge Wahyu Iman Santoso appreciated Richard's role as a justice collaborator and honesty in exposing the role of the former head of the National Police's Professional and Security Division or Propam, Ferdy Sambo, as the mastermind of this premeditated murder.

Richard received the lightest sentence among the other four defendants. The court sentenced Ferdy Sambo to death while his wife, Putri Candrawathi was sentenced to 20 years in prison. Two other defendants, Kuat Ma'ruf and Ricky Rizal, got 15 and 13 years in prison, respectively.
