Additional Leave Could Spark Conflict within Private Companies

TEMPO.CO, Jakarta - Many workers alliances in private sectors considered the facultative regulation on the additional collective leave for 2018 Eid al-Fitr holiday would not benefit them. The option for entrepreneurs to whether applying the regulation issued or not might spark a conflict between the company management and the workers.
The Democratic Labor Union spokesperson Sherin Sarinah said the workers tend to demand the additional collective leave in accordance with the joint decree (SKB) issued on April 18. On the other hand, entrepreneurs would likely reject the rule since it potentially loses the company’s benefit.
“Both parties might have a dispute in a bipartite level,” she said to Tempo on Monday, May 7.
According to Sherin, most workers demanded the additional leave for more rest days. The minimum wage increases, she noted, created workers' dependency on overtime pays. “[It’s] always overtime. The actual working time in manufacture sector is 10-12 hours a day,” she said, adding that more than 17 million labors working in the sector.
The joint decree (SKB) signed by three ministers stipulating June 11-12 and June 20 as collective leaves. Adding to Eid holiday on June 15-17 and four days of collective leaves that set before, the Eid holiday will be 10 days in a row.
The regulation was considered discriminatory. The leaves for private workers, Sherin went on to say, was cut from the annual leaves at some 12 days, based on the Article 79 of Law No. 13/2003 on the Employment. Meanwhile, the leaves for civil workers were not reduced from its annual leaves based on Presidential Decree No. 11/2017 on civil servant management.
