Govt Invites 16 Lawyers to Face Newmont

TEMPO.CO, Jakarta - Investment Coordinating Board chief Mahendra Siregar said the government has invited 16 international-affiliated lawyer agencies to attend government’s lawyer team selection to face PT Newmont Nusa Tenggara’s lawsuit in arbitrary court in he International Center for the Settlement of Investment Disputes (ICSID).


Mahendra hoped the process can be completed soon so that the government can be able to prepare subtantial preparation to face the lawsuit. “If this can be finished soon, we will then can select the arbitrator because that’s the process from the ICSID,” said Mahendra on Sunday.


PT Newmont filed a lawsuit on imposition of mineral export duty by the government amid negotiation process between the government and the mining company.


Coordinating Economic Minister Chairul Tanjung has said the government will not hesitate to countersue Newmont.


The government has also sent a reply to the ICSID regarding Newmont’s lawsuit. The letter states about rejection towards Newmont’s proposal to shorten the time for arbitrator selection. Newmont had asked the ICSID that arbitrator selection was only 30 days since the lawsuit was filed.
