TEMPO.CO, Jakarta - Commission IX House Legislator from the Democrat Party Lucy Kurniasari expressed her concern against government regulation in lieu of law (Perppu) on Job Creation. Lucy said that the regulation does not side with the general workers and failed to create legal certainty.

As an example, Lucy highlighted an article in the Perppu that regulates workers' right to personal breaks and office leave. She explained that workers' extended leave has been eliminated from the regulation even though such leave is a worker's right.

"Through extended leave, it is hoped that workers can recover physically and psychologically so that they can return to work feeling better and improve their performance," said Lucy to Tempo on Monday, January 2, 2023.

Pursuant to Article 81 paragraph (25) of the Perppu, which amends Article 79 of Law No. 13 of 2003 concerning Manpower, a worker is no longer entitled to a two-month sabbatical leave. Instead, a worker's sabbatical leave will be subject to provisions stipulated in work agreements, company regulations, or work agreements with certain companies.

She also highlighted that the Perppu adds regular work days from the previous 5 days to 6 days, Lucy argued that the initial provision on 5 regular work days is already sufficient.

"Because work productivity is not determined by the length of work. Therefore, five working days a week would be sufficient," said Lucy, who argued that the Perppu only benefits investors and businesses rather than workers.

Lucy also lamented that the Perppu on Job Creation does not provide legal certainty for workers. From its substance, Lucy asserted that the issuance of the Perppu was intended for the convenience of investors.
