Online Sexual Violence Regulated in TPKS Law; Here's the Detail

TEMPO.CO, Jakarta - The House of Representatives (DPR) officially passed the long-awaited bill on sexual violence into law or UU TPKS on Tuesday, April 12, 2022. Article 14 of the TPKS Law mentions nine types of sexual violence crimes.

One of them is online sexual harassment or abuse which is noted in Article 14 paragraph 1. There are three actions categorized in this type, as follows:

  1. Recording video and or taking pictures or screenshots of sexual content against the will or consent of the person who is the object of the recording video or pictures or screenshots.
  2. Transmitting electronic information and or electronic documents with sexual contents against the will of the recipient.
  3. Stalking and or tracking people who are objects in information or electronic documents for sexual purposes using an electronic tool.

In the policy, people who are proven to commit such cyber sexual harassment are subject to a maximum of four years in prison and or a maximum fine of Rp200 million.

The National Commission on Violence Against Women (Komnas Perempuan) Commissioner, Siti Aminah, opined that the regulation on online sexual harassment as regulated in the TPKS Law is a progressive step to provide protection to victims in electronic media given that complaints related to cyber sexual abuse continue to increase.

“The TPKS Law guarantees the rights of victims of online sexual violence to erase digital traces. It also integrates the work of the police and the Ministry of Communication and Information in the investigation process,” Siti said.
