TEMPO.CO, Jakarta - Manpower Minister Ida Fauziyah responded to the planned judicial review on Ministerial Regulation (Permenaker) No. 2 of 2022 concerning old-age benefits (JHT) to the Supreme Court.

She considered it a constitutional right of every citizen which is guaranteed by the 1945 Constitution. “The government respects the effort to review the Manpower Ministerial Regulation 2/2022 because it is part of the dynamics of democracy,” she said in an official statement, Thursday, Feb. 17.

Ida explained the ministry has a constitutional obligation to implement the policy until the Supreme Court decides otherwise as it had been promulgated. According to her, the regulation that has been in effect for three months after being promulgated on May 4, 2022, is not for the benefit of the government or BPJS Ketenagakerjaan.

“This Permenaker solely aims at strengthening the implementation of the JHT Program so that the benefits can be received optimally by participants, workers or laborers.”

She ensured that the JHT funds would not be used by the government and would be managed in a transparent and prudent fashion by providing competitive returns. This means the amount will be at least equivalent to the average deposit interest rate of a government bank.

“JHT funds remain the rights of workers and can be withdrawn when they reach the age of 56 with very simple document requirements, namely an ID card or other proof of identity; and BPJS Ketenagakerjaan card,” Minister Ida concluded.
