TEMPO.CO, Jakarta - A constitutional law expert from Andalas University, Feri Amsari, criticized State Secretariat Minister Pratikno for downplaying several errors in Job Creation Law or Law No. 11 of 2020. Pratikno said the typographical errors or typo were technical errors and had no effect on the implementation of the new law.

“It’s clearly not a clerical error (typo), but it’s a fundamental omission that loses the meaning. How come the State Secretary downplays the issue, while in fact, a law must have clear objectives and provide certainty,” said Feri on Wednesday, November 4, 2020.

According to him, any editorial errors found after the law is enacted cannot be just corrected. “The current plan for revision further proves that the procedure of the law-making is carried out recklessly. This is a law, not a used tire that can be retreaded,” Feri underlined.

Constitutional Law Expert, Bivitri Susanti, found two errors on the reference of previous articles in the omnibus law signed by President Joko Widodo or Jokowi, namely Article 6 Chapter III and Article 53 Chapter XI.

The mistake, said Bivitri, could not be underestimated because the law has been signed and the articles cannot be corrected carelessly. If the government wants to provide legal certainty so that these articles can be implemented, she added, government regulation in lieu of law or Perpu can be issued.

Pratikno in his statement on Tuesday, November 3, admitted there were errors in Law NO. 11 of 2020 on Job Creation, but he claimed it did not affect anything as it was mere administrative errors.
