Govt Passes Amended KPK Law, Taking Effect on Oct. 17

TEMPO.CO, Jakarta - The Ministry of Justice and Human Rights has registered the amended Law on Corruption Eradication Commission or KPK on the state gazette by Law No. 19 of 2019 concerning the law revisions.

“It has been listed on the state gazette No. 197 with the additional number (TLN) 6409 dated October 17, 2019,” said the ministry’s Director-General for Legislation Widodo Ekatjahjana as quoted from Antara, Friday, Oct. 18.

According to Widodo, the copy of Law No. 19/2019 could not be publicized as it is still being reviewed. “State Secretary is authenticating the document. After then, we will publish it on the website.”

On September 17, the House of Representatives (DPR) ratified the law revisions during the plenary meeting. Under Article 73(2) of Law No. 12/2011 on the Formation of Regulations, a bill that has not been signed by the president within 30 days from the date it has been passed shall become law and must be proclaimed.

With or without the president's signature, the controversial law on KPK will come into effect on October 17, 2019, or 30 days after it has been passed by default. Several legal experts considered the new regulation had too many weaknesses as it was drafted in a rush. Also, the law notes problematic articles that might cause legal chaos.
