LRT Depo; People to File Lawsuit on Land Claim in Jatimulya

TEMPO.CO, Bekasi - People living in Jatimulya sub-district, South Tambun district, Bekasi regency planned to file a lawsuit against PT Adhi Karya, a company constructing the light rail transit or LRT, over the land ownership claim.

The 11-hectares land was designed to be the train depot.

“We will register a lawsuit in West Java State Administrative Court (PTUN) after the election,” said the people’s lawyer Riano Osca on Sunday, April 7.

According to Riano, Adhi Karya claimed to possess the land based on the Government Regulation No. 3 of 1997 concerning the addition of the state capital for PT Adhi Karya’s share capital. “We consider this policy incorrect by law,” he said.

The reason, he added, the regulation noted the land in Setia Darma village, South Tambun, while PT Adhi Karya claimed his client’s land in Jatimulya village (now Jatimulya sub-district). Setia Darma village is located further in the east than that of Jatimulya,” Riano said.

In addition to the document, he added, the National Land Agency (BPN) of Bekasi noted the land in the status quo that was exposed during a meeting between related institutions with the locals in 2017. “BPN cannot show the legal ownership of the land claimed by PT Adhi Karya,” he added.

Therefore, Riano went on, the land that was planned to become the LRT depo belongs to no one, “and locals have the right to own it based on the Basic Agrarian Law No. 5 of 1960.”
