TEMPO.CO, Surakarta - PT Bank Mutiara Tbk. refused to compensate Solo customers who bought Antaboga's mutual funds, which turned out to be a scam, despite the Supreme Court's ruling that the bank formerly known as Bank Century must compensate the money lost.
The refusal was delivered by Bank Mutiara's attorney Medi Purba after a closed-door meeting in Surakarta's District Court, Tuesday, April 21. The meeting was also attended by representatives of the Bank Century Customers Forum.
Medi asserted that Mutiara will not carry out the court's decision as the customers invested in mutual funds issued by PT Antaboga Delta Sekuritas, even though they purchased the funds at Mutiara's counters.
"We can only return the money if it was within our hands. The fact is, we don't have their money," Medi said.
In the cassation hearing, the Supreme Court sentenced Bank Mutiara to indemnify customers' money that was used to buy Antaboga's mutual fund products.
The lawsuit was filed by 27 customers who purchased the funds. The court ordered Mutiara to return clients' investment, which totaled at Rp35.4 billion. The bank was also ordered to pay Rp5.6 billion in damages fee.
