Judicial Commission Reviews Rule in Favor of La Nyalla

TEMPO.CO, Jakarta - The Judicial Commission (KY) continued to monitor the pretrial hearing of a lawsuit filed by East Java Chamber of Commerce and Industry (Kadin) chairman La Nyalla Mattalitti at the Surabaya District Court.


However, East Java KY coordinator Dizar Alfarizi said that his institution would not announce the result of its observation in the near future.


“We found several things,” Dizar told Tempo on Wednesday, April 13, 2016.


According to Dizar, judges independence must be maintained. Although the scope of pretrial under Constitutional Court’s Decision No. 21/2014 has been extended, Dizar said that it was still prone to intervention.


“We need to be careful in reviewing the case,” he added.


Earlier on March 12, 2016, sole judge Fedinandus ruled in favor of La Nyala in a lawsuit related to his suspect naming in a graft case. The verdict said that La Nyala’s suspect naming was illegal since there were no state losses involved.


During the hearing, La Nyalla’s lawyer proved that the money, which was used to acquire Bank Jatim’s shares, had been returned. However, the prosecutor found that the receipt was signed in 2012, but the duty stamp was issued in 2014. The judge overlooked the evidence.


“Regardless the duty stamp issue, no state losses were involved,” Surabaya District Court spokesperson Efran Basuning said.


The Surabaya District Court also approved the pretrial motion in a graft case surrounding the grant fund paid to the East Java Kadin. The pretrial motion was filed by East Java Kadin deputy chairman Diar Kusuma Putra, who was summoned as a witness by the East Java High Prosecutor’s Office.
