Kampung Akuarium Residents Revoke Lawsuit to Anies Baswedan

TEMPO.CO, Jakarta - The residents of Kampung Pasar Ikan (Fish Market Village), Penjaringan, North Jakarta, officially revoked the class action lawsuit against the Jakarta Governor Anies Baswedan. Instead, the community demands the promise by Anies to rebuild a village known as the Kampung Akuarium (Aquarium Village).

"Today, the panel of judges of the Central Jakarta District Court officially revoked the class action lawsuit of Kampung Aquarium residents," said Dharma Diani, one of the plaintiffs in his written statement on Tuesday, June 26.

Dharma explained the reason was due to the issuance of Governor’s Decree of the Jakarta Province No. 878/2018 on the Task Force Implementation of Village and Community Arrangement.

The Governor's Decree is the legal basis for the arrangement of 21 villages spread across Jakarta, including Kampung Akuarium.

“The residents of Kampung Aquarium appreciate Anies's move in accordance with what he has promised,” Dharma said.

Anies is said to have re-activated the ID Card and built a shelter for local residents. Including making the Community Action Plan (CAP) to organize Kampung Akuarium and other villages in Jakarta.

"But we are still waiting for another Anies’s promise to rebuild the Kampung Akuarium," said the statement which also stated, "The Kampung Akuarium residents will continue to wait for the promise of rebuilding the the village and guarding the process,” said Dharma.

Previously, the lawsuit was filed after a forced demolition by Governor Basuki Tjahaja Purnama alias Ahok in 2016. The residents of the Kampung Akuarium were declared unlicensed and the slum inhabited by 345 families has violated the designation.

Besides the Jakarta Administration, the lawsuit was also addressed to the Police Chief of the Republic of Indonesia (Kapolri), Commander of the Indonesian National Army (TNI), and Head of the National Land Agency (BPN). The lawsuit was made based on an offensive act by the authorities (onrechtmatig overheidsdaad) as regulated in Article 1365 of the Civil Code.
