Constitutional Court Grants Judicial Review of Job Creation Law, Labor Party: Justice Prevails

TEMPO.CO, Jakarta - Said Iqbal, President of the Labor Party, expressed his relief and gratitude after the Constitutional Court granted a partial judicial review of the Job Creation Law.
“Justice prevails. We appreciate the Constitutional Court's judges. No dissenting opinion today,” Iqbal said on Thursday, October 31.
The Constitutional Court granted part of the judicial review petition of Law Number 6 of 2023 concerning Job Creation filed by his party along with several other labor unions.
Said pointed out that the nine constitutional judges unanimously granted part of the judicial review petition. The court granted the constitutional review of 21 normative provisions in the Job Creation Law.
Said also highlighted the court's order for the House of Representatives (DPR) and the government to enact a new law on manpower within two years. “Our fate should be determined by labor laws, not solely by the interests of capital,” he asserted.
He urged the DPR to strictly adhere to the court's ruling and avoid any misinterpretation. He also appealed to President Prabowo Subianto to respect the decision and prioritize the welfare of Indonesian workers.
“Bapak President Prabowo, please support the people and respect their rights. The people have achieved justice. We’ve taken legal paths. We’ve done social movements. Please honor this decision,” Said pleaded.
The Labor Party, along with the Federation of Indonesian Metal Workers Union (FSPMI), the Confederation of All Indonesian Workers Unions (KSPSI), the Confederation of Indonesian Labor Unions (KPBI), and the Confederation of Indonesian Workers Unions (KSPI), had filed the judicial review petition.
The court's decision addresses critical issues such as foreign worker regulations, fixed-term employment contracts, outsourcing, leave entitlements, wages, layoffs, and severance pay.
