Trade Minister Zulkifli Hasan Issues New Regulation on Certificates of Origin for Imports

TEMPO.CO, Jakarta - Trade Minister Zulkifli Hasan has issued Regulation of the Minister of Trade (Permendag) No. 16 of 2024 concerning the Rules of Origin and Certificates of Origin (SKA) for Imported Goods in The Enforcement of Trade Safeguard Measures. This regulation aims to mitigate disputes or irregularities in the collection of safeguard duties (Bea Masuk Tindakan Pengamanan - BMTP).
According to Zulkifli Hasan, the regulation is part of efforts to prevent serious harm to domestic industries due to a surge in imports or unfair trade practices. Zulkifli claimed that this regulation would ensure the successful recovery of losses suffered by domestic industries.
“This regulation is expected to optimally enhance the protection of domestic industries,” Zulkifli Hasan stated in a written statement on Friday, August 9, 2024.
Under the new rules, importers from countries exempted from safeguard duties (BMTP) are required to include a non-preferential Certificate of Origin for imports subjected to safeguard measures. Importers who fail to provide the SKA will face safeguard duties imposed by customs authorities in accordance with existing regulations.
Zulkifli Hasan also noted that this regulation serves as a guideline for the Indonesian Customs Authority, specifically the Directorate General of Customs and Excise of the Ministry of Finance, in examining the origin of goods and non-preferential SKA during imports. The examination includes origin criteria, consignment criteria, and procedural provisions for the non-preferential SKA from exporting countries.
Previously, field inspections of the SKA encountered challenges due to varying standards for issuing non-preferential SKA based on the exporting countries' regulations, as outlined in Permendag No. 37 of 2008. These differences made it difficult to conduct origin and SKA verification.
“The detailed rules on how to examine the origin of goods from exporting countries will serve as a guideline in SKA inspection for imports subjected to safeguard measures and the imposition of BMTP,” Zulkifli Hasan added.
Permendag No. 16 of 2024 improves upon the previous regulation, Permendag No. 37 of 2008, regarding Certificates of Origin for imported goods subject to safeguard measures. The regulation was enacted on July 2, 2024, and came into effect on July 12, 2024.
