DPR Passes KIA Bill, Maternity Leave Set for Up to 6 Months

TEMPO.CO, JakartaThe House of Representatives (DPR) passed the bill on mother and child welfare, or RUU KIA, into law on Tuesday, June 4. This law grants working mothers and their spouses the right to maternity leave during the childbirth period.

Diah Pitaloka, Deputy Chair of Commission VIII, explained that this law allows a working mother to take a minimum of three months of maternity leave. However, under special conditions, a working mother can take leave for up to six months.

“Working mothers using their maternity leave rights cannot be dismissed,” she said at the 19th DPR Plenary Meeting for Session V 2023–2024 at the Parliament Complex in Senayan, Central Jakarta on Tuesday, June 4, 2024.

While on maternity leave, Diah said a mother has the right to receive full salary for the first four months. As for the fifth and sixth months, she is eligible for 75 percent of her salary.

The law also mandates the presence of the husband during childbirth. Diah explained that the husband has the right to two days of leave and potentially three additional days of leave. The length of leave can also be adjusted in consultation with the employer. Husbands whose wives have miscarriages are entitled to a two-day leave.

The PDIP politician claimed that deliberations on the KIA Bill had involved trade unions, community organizations, academics, and business actors. Ministries/institutions, she added, were also invited to discuss the synchronization of related regulations.

Diah said the KIA Law comprises nine chapters and 46 articles governing rights and obligations, duties and authority for administering maternal and child welfare, data and information, as well as funding and community participation. According to her, the law focuses on regulating the welfare of mothers and children in the first thousand days of life, spanning from fetal development in the womb until the child is two years old.
