Former Pertamina CEO Karen Agustiawan Sentenced to 9 Years in Prison for LNG Corruption

TEMPO.CO, JakartaThe judges of Jakarta Corruption Court Crime sentenced the former CEO of Pertamina, Galaila Karen Kardinah or Karen Agustiawan, to 9 years in prison and a Rp500 million fine for LNG corruption.

"(The Court) sentenced the defendant, therefore, to 9 years in prison and a fine of Rp500 million subsidiary of 3 months in prison in case of failure to pay the fine,” said Judge Maryono on Monday, June 24, 2024.  

The judge said Karen was found, beyond unreasonable doubt, guilty of corruption. 

The sentence given was lighter than the prosecutor's demands of 11 years and a Rp1 billion fine, subsidiary to six months in prison. The prosecutor believes Karen violated Article 2 (1) in conjunction with Article 18 of the Corruption Eradication Law in conjunction with Article 55 (1) of the Criminal Code in conjunction with Article 64 (1) of the Criminal Code as the first indictment.

The prosecutor also demanded Karen Agustiawan pay Rp1,091,280,281 (Rp1 billion) and US$104,016 of compensation within one month after the final verdict. Failure to comply will result in Karen’s properties being confiscated and auctioned, or subsidiary two years in prison.

The prosecutor accused Karen of causing a state loss of US$113.84 million or Rp1.77 trillion in the LNG (Liquified Natural Gas) procurement case. Karen was also charged with enriching herself with Rp1.09 billion and US$104,016 or Rp1.62 billion, as well as enriching a United States corporation, named Corpus Christi Liquefaction LLC worth US$113.84 million, resulting in state financial losses.

Additionally, Karen was also accused of approving the development of the gas business to several potential LNG plants in the US without clear procurement guidelines.

Karen was said to have not asked for a written response from the Pertamina Board of Commissioners and approval from the General Shareholders Meeting (GMS) before signing the CCL Train 1 and Train 2 LNG sale and purchase agreement (SPA), as well as giving power of attorney to Yenni Andayani as 2013-2014 Senior Vice President (SVP) of Gas and Power Pertamina and Hari Karyuliarto as 2012-2014 Director of Gas at Pertamina.

Both of them were authorized to sign the LNG SPA CCL Train 1 and Train 2, despite not all Pertamina Directors had signed the Board Meeting Minutes for the LNG SPA CCL Train 1 and without the support of the board of directors' approval for the LNG SPA CCL Train 2.

For her actions, Karen was charged with Article 2 (1) and Article 3 in conjunction with Article 18 of the Corruption Eradication Law as amended by Law Number 20 of 2001 in conjunction with Article 55 (1) of the Criminal Code in conjunction with. Article 64 (1) of the Criminal Code.
