Anies-Muhaimin Legal Team Expresses Optimism Towards MK Decision on Election Dispute

TEMPO.CO, Jakarta - The Head of the Legal Team for the Anies Baswedan and Muhaimin Iskandar National Winning Team (Timnas Amin) Ari Yusuf Amir, is optimistic that the Constitutional Court (MK) will grant their demand regarding the dispute over the 2024 presidential election (pilpres).
"We must be optimistic [that the demands will be granted] because we still believe that the judges, during the trial process, have delved much deeper into the substance of the matter," said Ari when contacted on Sunday, April 14, 2024.
From the developments in the hearings conducted so far, Ari sees that the judges are inclined not only to discuss the technical results but also the process and substance of the issues raised. "Namely, about the occurrence of constitutional violations, occurrences of fraud. The judges discussed that more during the trial process, so we are optimistic," Ari said.
However, according to Ari, the final decision of the MK ultimately depends on the courage of the judges themselves. With all the testimonies, evidence, and experts presented, Ari claimed that the judges actually believe that there have been fraud and constitutional violations. "Now it's just a matter of their courage [in making decisions]. Why? Because what they are facing is the current ruling regime," Ari said.
It is known that the Constitutional Court has completed the trial examination in the dispute over the 2024 presidential election (PHPU) on Friday, April 5, 2024. Before announcing its decision on Monday, April 22, the MK will hold a formal judges' meeting on April 16, 2024.
Meanwhile, for now, the constitutional judges are conducting a thorough examination of the trial results held from March 27 to April 5.
In the last PHPU hearing, the MK summoned four cabinet ministers of President Jokowi as witnesses regarding allegations of social assistance politicization in the 2024 presidential election dispute. The ministers who attended were Finance Minister Sri Mulyani, Coordinating Minister for Human Development and Culture Muhadjir Effendy, Coordinating Minister for Economic Affairs Airlangga Hartarto, and Social Affairs Minister Tri Rismaharini.
The dispute over the 2024 presidential election involves two applicants, namely presidential candidate pair number 01 Anies Baswedan-Muhaimin Iskandar as the first applicant and candidate pair number 03 Ganjar Pranowo-Mahfud MD as the second applicant.
Both sides filed similar demands, namely to disqualify presidential candidate pair number 02, Prabowo Subianto-Gibran Rakabuming Raka, and requesting a repeat of the presidential election without that pair.
The alleged politicization of social assistance is one of the main points in the presidential election dispute lawsuits filed by the Anies-Muhaimin and Ganjar-Mahfud pairs to the Constitutional Court. These lawsuits are numbered 1/PHPU.PRES-XXII/2024 filed by the 01 Anies-Muhaimin camp, and number 2/PHPU.PRES-XXII/2024 filed by the 03 Ganjar-Mahfud camp.
