TEMPO.CO, Jakarta - The Constitutional Court or MK has 14 days to resolve the application for the General Election Results Dispute (PHPU) or the 2024 presidential election dispute after the application is recorded in the e-BPRK or electronic Constitutional Case Registration Book. However, this time span was cut by the Eid holiday period, namely April 8 to 13, 2024.
So, what is the Constitutional Court hearing schedule related to PHPU 2024 after the Eid holiday?
Stages of the 2024 PHPU case trial at the Constitutional Court session began with registration on March 25, 2024. Then, proceeded with announcing the trial schedule on March 26, 2024. The first trial was held on March 27, 2024, and so on. The PHPU trial stage was declared completed on the 12th day on Friday, April 5, 2024.
"(On) 25 (March) registration, 26 (March) was the notification of the hearing day, 27 (March) was the day of the trial, trial, trial, trial," said Constitutional Court spokesperson Fajar Laksono when met at his office, Central Jakarta on Thursday, March 21, 2024.
Fahar said what counts is working days. So, joint leave and Eid holidays are not counted. The Lebaran holiday is 8, 9, 10, 11, 12, 13 (April), practically it is not a court day because it is not a working day," Fajar said. "So it will be continued, if there is another hearing, it will be on April 15-22 (April)."
Schedule for the next presidential election dispute hearing after the Eid holiday
Fajar Laksono said that the next presidential election dispute hearing is a statement of the Constitutional Court's decision. The PHPU verdict will be held on Monday, April 22, 2024. "The verdict will be on April 22, 2024," he said when he met at his office in Central Jakarta on Thursday, March 21, 2024.
The date has been listed in Constitutional Court Regulation Number 1 of 2024 concerning Stages, Activities, and Schedules for Handling Cases on Disputes over General Election Results for Members of the DPR, DPD, DPRD, and General Elections for President and Vice President.
MK opens the stage of submitting conclusions
After the end of the trial phase of the case, the Constitutional Court will open the stage of submitting conclusions in handling the 2024 presidential election dispute case. The agreement was conveyed by the Chief Justice of the Constitutional Court, Suhartoyo, at the end of the continued trial of the PHPU case for the 2024 presidential election.
"We, the panel of judges, agreed that if there are things that still want to be submitted, even though this is the last trial, they can be accommodated through conclusions," said Suhartoyo.
Suhartoyo said that previously, the stage of submitting conclusions in the PHPU Pilpres trial was not required. However, in this case, there are many different dynamics. The Court accommodates the submission of crucial matters and the submission of files that are still left behind through that stage.
He said the related party, namely the Prabowo-Gibran Defense Team, had not submitted witness and expert testimony. These files can be submitted at the stage of submitting this conclusion. The last deadline for submitting conclusions is April 16, 2024, at 16.00.
"This opens up new and special opportunities for the PHPU (Presidential Election Dispute) hearing. That's their right. If they don't want to, that's fine," he said.
