TEMPO.CO, Jakarta - President Joko Widodo or Jokowi's Special Staff on Legal Affairs Dini Purwono said Jakarta remains the capital city until the issuance of a Presidential Decree on capital city transfer. She said this was based on Article 39 of the IKN Law.
"When exactly the Presidential Decree will be issued, depends entirely on the President's authority," Dini said in a short message to Tempo on Thursday.
Dini then referred to Article 41 of the 2022 IKN Law. The article states that after the IKN Presidential Decree is issued, Jakarta’s status as the capital city of Indonesia is revoked and declared invalid.
"But of course, the right timing will be decided by the government. So the time gap between the issuance of the IKN Presidential Decree and the issuance of the Jakarta Specificity Law is not too long so that everything can run neatly," Dini said.
Presidential Special Staff Coordinator Ari Dwipayana did not reply to a message sent on Thursday morning when asked whether Jokowi had prepared a Presidential Decree to move the capital city to IKN.
Previously, Chairman of the House of Representatives (DPR) Legislation Body Supratman Andi Agtas said Law No. 29 of 2007 on Jakarta as the country's capital city expired on February 15. This is the implication of the IKN Law which has been promulgated since February 15, 2022.
"[Jakarta] lost its status on February 15," Supratman said in Jakarta on Tuesday.
Supratman referred to the 2022 IKN Law Article 41 paragraph 2 which states, 'Within a maximum period of 2 (two) years as of the promulgation of this Law, Law Number 29 of 2007 on the Provincial Governance of the Special Capital Region of Jakarta as the National Capital of the Unitary State of the Republic of Indonesia is amended in accordance with the provisions of this Law.'
