TEMPO.CO, Jakarta - PT Garuda Indonesia (Persero) Tbk. has won the appeal of the lawsuit filed by Greylag Entities at the Paris Court of Appeal. The ruling pertains to the Paris Commercial Court's rejection of the lawsuit filed by Greylag Goose Leasing 1410 Designated Activity Company and Greylag Goose Leasing 1446 Designated Activity Company on February 9, 2023.
The reinforcement of legal compliance is further supported by the recent victory of Garuda Indonesia Holiday France S.A.S (GIH) in a judicial release case. Greylag Entities was ordered to pay €80,000 (approx. Rp1.36 billion) to its subsidiary, Garuda Indonesia Holiday France (GIHF), as per the official decision made on February 22, 2024.
Garuda Indonesia president director Irfan Setiaputra stated that this ruling strengthens the company's legal foundation in ensuring that creditors' interests are met. This is in line with the settlement agreed upon for the PKPU (debt settlement postponement) procedure in 2022.
"With this legal provision, our next focus is to ensure Garuda Indonesia's transformation mission and fulfill its obligations as approved by the majority of creditors," Irfan said in a written statement on Thursday.
This appeal is a continuation of Greylag's legal efforts against GIHF's judicial release decision regarding the temporary confiscation of GIHF's accounts by the lessor of the Greylag 1410 and Greylag 1446 aircraft in 2022.
Greylag Entities previously filed legal efforts in various countries to cancel the 2022 Garuda Indonesia PKPU settlement. However, the legal authorities of each country rejected these efforts.
In 2022, Garuda Indonesia faced several lawsuits related to the restructuring process by Greylag Entities through GIHF. However, the Paris Commercial Court did not accept these lawsuits. A lawsuit in the Supreme Court of New South Wales, Australia was also halted, and a PK (Judicial Review) attempt in the Indonesian Supreme Court was won by the airliner.
"We hope that Garuda Indonesia's successful completion of this legal process will boost capital market stakeholders' confidence for a positive outlook for Garuda Indonesia's businesses in the future," Irfan said.
