YLBHI Demands Jokowi to Revoke TNI - Police MoU

TEMPO.CO, Jakarta - Foundation of the Indonesian Legal Aid Institute (YLBHI) demanded President Joko `Jokowi` Widodo revoke Memorandum of Understanding (MoU) between national Military (TNI) and Police.


They considered the MoU signed by National Police chief Gen. Tito Karnavian and Indonesian Military chief Hadi Tjahjanto can challenge the spirit of civil supremacy upheld in Indonesia.


"MoU of assistance without a legal decision from the president is an anomaly in a governance that uphold civil supremacy," YLBHIchairwoman Asfinawati said on Saturday, Feb. 3.


Regulation No. B/2/2018 and No. Kerma/2/I/2018 in the MoU stated that the Military will be involved to handle mass movement. The problem is, Asfinawati went on, the authority and responsibility of deployment of military forces are in the hands of the president. It is stipulated in Indonesian National Military Law Article 3 paragraph 1.


In deploying TNI, the president has to obtain approval from the House of Representatives. According to TNI Law Article 7 paragraph 3, the deployment of TNI for military operations has to be under the consideration of state politics. "MoU does not belong to state politics," Asfinawati said.
