TEMPO.CO, Surabaya - Fajar Kurniawan, chairman of the East Java branch of Hizbut Tahrir Indonesia (HTI), said that he was surprised that inactive Jakarta Governor Basuki “Ahok” Tjahaja Purnama was probed by the National Police’s Criminal Investigation Corps (Bareskrim) over an allegation of religious defamation.
“If he was summoned [for questioning], then it’s a progress,” Fajar told Tempo on Monday, November 7, 2016.
Fajar claimed that Ahok had clearly insulted Islam by making a statement related to Surah al-Maidah verse 51 of the Quran. He argued that Ahok should be imposed by sanctions based on both positive law and Islamic law.
In the sense of positive law, he added, the sanction should be imposed based on Article 156-a of the Criminal Code and Presidential Regulation No. 1/PNPS/1965.
“Police can take many examples of religious defamation cases occurred in several places,” he said.
Therefore, Fajar hopes that police would assure transparency in investigating the case, as well as in selecting witnesses.
“At least Ahok is punished in the sense of positive law,” Fajar went on.
On Monday, November 7, 2016, the National Police probed Ahok as a witness in connection with an allegation of religious defamation. National Police spokesperson Boy Rafli Amar said that the National Police also summoned key witnesses that would determine Ahok’s fate.
