Jakarta Wins Appeal over Permit for Islet G

TEMPO.CO, Jakarta - Jakarta administration has won its appeal against Jakarta State Administrative Court’s (PTUN) ruling that overturned the permit for islet G construction, which is part of the city’s reclamation project. “Yes, PTUN’s ruling has been overturned by the Administrative Court of Appeal,” Jakarta Legal Department head Yayan Yuhanah told Tempo on Thursday, October 20, 2016.
Jakarta Governor Basuki Tjahaja Purnama or Ahok said he is pleased with the court’s ruling because it means that he can continue the reclamation project. “It [reclamation] will certainly be resumed. I have said it before that I'd be pleased if it could be overturned, [since] it would pave my way to assume control of BUMD’s [regional-owned enterprise] land,” he said at the Jakarta City Hall.
Earlier, Jakarta administration had filed an appeal to the Administrative Court of Appeal following PTUN’s ruling in favor of Jakarta Bay fishermen in a lawsuit against the Jakarta administration filed in May, 2016, over Ahok’s decree on reclamation permit to PT Muara Wisesa Samudra, a subsidiary of PT Agung Podomoro Land.
PTUN’s judges had previously ruled in favor of the fishermen, opining that the reclamation project did not serve the public interest and could adversely affect marine ecosystem around Islet G.
Tigor Hutapea, people’s advocate of the Legal Aid Institute (LBH), who represented Jakarta Bay fishermen, said he could not yet comment on the Administrative Court of Appeal’s decision. “I have not read the ruling. I have to read it first before giving any response,” he said.
