TEMPO.CO, Jakarta - Jakarta Governor Basuki “Ahok” Tjahaja Purnama said that he will continue the reclamation project despite any possible ruling that is legally binding in relation to the annulment of Jakarta gubernatorial decree on reclamation permit of Island G by Jakarta Administrative Court.

“The reclamation will continue with our own permit. We may use Jakpro (PT Jakarta Propertindo) to carry out the project. If it [gubernatorial decree] was annulled, I don’t know what the verdict was. The PTUN’s [Administrative Court] ruling is not against reclamation,” Ahok said at Cengkareng General Hospital, West Jakarta, Tuesday, May 31, 2016.

The judges of Jakarta Administrative Court have ruled in favor of Indonesian Traditional Fishermen Coalition who had pelad for the court to annul Jakarta gubernatorial decree that granted the permit for reclamation project of Island G to the subsidiary of Agung Podomoro Land, PT Muara Wisesa Samudera.

According to chief justice Adhi Budi Sulistyo, several things had been taken into consideration in the ruling, among others, that the reclamation is not urgent for the public interest. “No public interest in the reclamation,” he said at Jakarta Administrative Court, Tuesday, May 31, 2016.

In addition, Adhi considered that reclamation permit issued by the developer in the reclamation project of Island G, PT Muara Wisesa Samudra, is invalid, citing lack of coastal management regulation and coastal spatial planning.

Ahok asserted that if Jakarta gubernatorial decree No. 2238/2014 was annulled by the Administrative Court, he will issue a new regulation and offer a new tender to regional-owned enterprise PT Jakarta Propertindo (PT JakPro).

Ahok reasoned that Jakarta administration will not violate any regulation if it appoints regional-owned enterprise to carry out the project. “We reserve the right, it [the area] is ours, owned by Jakarta. Therefore, if he [the judge] had annulled it, we have to study the legal basis of it first [before taking further actions],” Ahok said.
