MK Honorary Council Reveals 3 Potential Ethics Sanctions for Anwar Usman

TEMPO.CO, Jakarta - The Chairman of Honorary Council of the Constitutional Court (MK) Jimly Asshiddiqie revealed three potential ethics sanctions against MK Judges, including Anwar Usman if a violation is found.

"Based on the MK Regulation, there are three [kinds of sanctions], reprimand, warning, and termination," Jimly said when met by reporters on Tuesday evening. The council examined four applicants and three constitutional judges including Anwar Uswan yesterday.

The most severe sanction, Jimly explained, is termination. Termination also comes hierarchically, dishonorable termination and honorable termination. "There is also a termination as Chief Judge only, but still a part of MK," he said.

The second degree of sanction is a warning, also with variations of warning degrees that were not provided explicitly in the regulation. Meanwhile, the lightest form of penalty is reprimand, which is divided into oral reprimand and written reprimand.

The former Chief Judge MK also stated that the council would be the one to decide which form of penalty would be given to the judges if a violation is found. "We'll see [the penalty]. That would be decided later based on the council's creativity," he said.

The council hearing would continue today, with the TPDI group as the applicant, and three judges, Saldi Isra, Manahan, and Suhartoyo scheduled to be examined.

MK Honorary Council will conduct this hearing every day until Friday. The council will examine the remaining reports from 18 applicants and six remaining MK judges involved in the case.
