Officials Drafting Job Creation Perppu Not Understand Legislation, Legal Expert Says

TEMPO.CO, Jakarta - A number of experts argued that Government Regulation in Lieu of Law (Perppu) No. 2 of 2022 concerning job creation is not in favor of the community. Academician and Director of the Center for Constitutional Studies (PUSaKO) at Andalas University’s Faculty of Law, Feri Amsari, believed that it is the investors who benefit from this regulation.

“People who will gain the advantage have been conveyed by Coordinating Minister for the Economy (Airlangga Hartarto), that this Perppu is for investors. [It’s for legal certainty in] investment, so investors will benefit,” said Feri in the Salemba 87 Discussion Forum held virtually on Saturday, January 7, 2022.

He explained that investors indeed get investment certainty. However, the public criticized the Perppu for not fighting for the interests of the community. “So it will be the community that will be harmed later.”

Additionally, others who will benefit from it are legal experts in the government who gave a stamp until the Perppu was issued.

Feri opined that the officials got a project or at least looked for a project through the new rules. Moreover, the formulation of the Perppu is not in line with the concept of statutory science.

Experts gathered in the process of deliberating the Perppu on job creation, he went on, might not really understand the legislation. “It seems that this Perppu is not detailed in the concept of legislation, so it could be said that this did not follow the science of legislation because it was forced [to be issued],” he concluded.
