TEMPO.CO, Jakarta - Media group Media Nusantara Citra or MNC Group CEO Hary Tanoesoedibjo or Hary Tanoe will take legal action over the government’s policy on the migration of analog television to digital television dubbed the analog switch-off (ASO). He deemed the policy to have no definite legal basis.

Hary explained that the policy contradicts the Constitutional Court’s ruling number 91/PPU-XVIII/2020 which states that the court suspends all strategic and broad-impact actions or policies.

“It is also not allowed to issue new implementing regulations related to Law No. 11 of 2020 concerning Job Creation,” said Hary in his Instagram statement, on November 3, 2022.

The ASO program is the implementation of the Job Creation Law, which mandates the government to migrate analog TV broadcasts to digital ones no later than November 2, 2022.

Hary said ASO only applies in the Greater Jakarta area or Jabodetabek and is not implemented simultaneously in all national broadcast areas. This, he argued, proves the Constitutional Court's verdict is correct and that the Communication and Informatics Ministry (Kominfo) recognized it.

“This means ASO that is limited to Jabodetabek is not an order from the law but is a decision of the Kominfo Ministry,” Hary emphasized.

He reiterated that the criminal and civil lawsuits submitted by MNC Group are aimed at obtaining legal certainty and are for the public interests, “according to applicable law.”

Despite taking legal steps, MNC Group confirmed that it had turned off analog TV broadcasts of RCTI, MNCTV, iNews, and GTV on Friday, November 4, 2022, at the request of Coordinating Minister for Politics, Law, and Security Mahfud MD.
