Kominfo Responds to Alleged Human Rights Violation in PSE Policy

TEMPO.CO, Jakarta - The Communications and Informatics Ministry's (Kominfo) director general for applications and informatics Semuel Abrijani Pangerapan ensured that the ministry’s regulation No. 5/2020 which requires the registration of electronic system operators (PSE) is not aimed at curbing the people’s freedom of expression, but rather to take action against violations.

The regulation, he said, is not only applied in Indonesia but also in other countries. Besides, several articles that are considered problematic are to take action against companies committing crimes.

“This rule is to crack down on illegal companies such as Binomo or DNA Robot. The law enforcers must enter the system if their system commits crimes,” said Semuel in a press conference on Tuesday, July 19, 2022.

With the Kominfo Ministry’s Regulation No. 5 of 2020, he went on, the police will have direct access to PSE breaching the rule. This is also an international policy.

"If there is a crime, Kominfo needs to know, the police need to know, we will verify the data. [We can have the access when] there is already a case. We cannot ask the platform suddenly when there is no case."

As for articles prohibiting content that disturbs public order, Semuel explained that it is aimed at monitoring content that may divide society, such as blasphemy. “We used to contact Google to make sure this content cannot be accessed in Indonesia,” he said.
