YLBHI Deems Court's Ruling on Job Creation Law Vague, Indecisive

TEMPO.CO, Jakarta - The Indonesian Legal Aid Foundation (YLBHI) argued that the Constitutional Court’s (MK) ruling on the judicial review of Job Creation Law or Law No. 11 of 2020 is vague and indecisive.

The Constitutional Court stated today (Nov 25) that the omnibus law is contrary to the 1945 Constitution and allows the law to remain in force until an amendment is made within two years after the verdict is read, or it would be deemed "permanently unconstitutional".

“This ruling is a compromise decision. Although stating that it is contrary to the Constitution, the Constitutional Court issues a vague decision or does not dare to rule straight and firm decision based on the legal logic and the MK Law,” said YLBHI and other 17 legal aid foundations throughout Indonesia on Thursday, November 25.

YLBHI opined that the court should just revoke the law so as not to create legal uncertainty.

The government is also urged to immediately stop the implementation of the Job Creation Law and all of its derivatives, as well as immediately halt national strategic projects that have abolished people’s rights and harmed the environment.

Coordinating Minister for Economic Affairs Airlangga Hartarto said the government respected the ruling and would comply with the court's instructions.
